Terms of Service
By using GigHive, you agree to the following terms and conditions. Please read them carefully.
GigHive (Freelance Provider) is represented by Corefix technologies, with its principal office located at Nkwashi estates, choongwe , lusaka zambia, Zambia. GigHive operates the GigHive Platform (“GigHive Platform”), a digital marketplace connecting clients with freelancers for various services and engagements (“Gigs”). Freelancers are engaged as independent contractors and receive compensation directly from GigHive.
As an independent contractor, Freelancers are not eligible to participate in any benefit programs, including but not limited to medical, dental, vision, disability, and retirement programs provided by GigHive.
Freelancers understand that each Gig is subject to final approval by a Platform User. Freelancers shall not be entitled to any fees unless engaged on the GigHive Platform to work on a specific Gig. This Agreement becomes effective only when a Freelancer begins work on an approved Gig. Engagements are on an as-needed basis and may be terminated by either GigHive or the Platform User at any time with or without cause, provided that payment is made for services rendered up to termination.
Upon completion of a Gig, Freelancers must notify GigHive. Failure to do so may affect the Freelancer’s ability to receive fees.
A Gig begins when a Freelancer starts work for a Platform User and ends when the Gig concludes. Freelancers may remain eligible for future Gigs but are not employed by GigHive beyond assigned Gigs. Gigs are on-demand and may be sporadic; GigHive does not guarantee fixed Gigs.
All content on the GigHive Platform, including text, graphics, designs, logos, and any Freelancer-generated content during a Gig (“Proprietary Material”), is owned by GigHive. Freelancers agree not to modify, copy, frame, scrape, rent, lease, loan, sell, distribute, or create derivative works based on Proprietary Material without explicit authorization.
Freelancers will be paid directly by GigHive for all completed Gigs. Posted Gig fees are gross rates, and Freelancer earnings per hour will reflect necessary deductions. For payment inquiries, contact support@gighive.com.
Freelancers agree to perform Gigs professionally and competently, using their own skills without third-party tools unless authorized. By accepting a Gig, Freelancers warrant that they are qualified, have no criminal convictions related to moral turpitude, and will comply with all applicable laws and Platform rules. Freelancers must not misuse confidential information or engage in prohibited activities as outlined.
Freelancers affirm they are not residing in or associated with any sanctioned countries or regions, including but not limited to those listed by the United Nations, European Union, or Zambia’s regulatory bodies. Any change in this representation must be promptly communicated to GigHive, and violations may result in termination and legal action.
Freelancers must not disclose any confidential or proprietary information obtained during their engagement with GigHive or Platform Users. This obligation persists beyond the termination of the Gig and Freelancer’s relationship with GigHive.
GigHive may use Freelancers’ profiles to market to Platform Users. Platform Users can rate Freelancers, and these ratings may be publicly displayed on the GigHive Platform.
This Agreement constitutes the entire agreement between the Parties regarding its subject matter and supersedes all prior agreements. Any modifications must be in writing and expressly agreed upon by both Parties.
If any provision of this Agreement is found unenforceable, the remaining provisions shall remain in full effect.
Freelancers acknowledge that they have read, understood, and agree to these terms before engaging with GigHive.
GigHive reserves the right to conduct background checks on Freelancers as required by law. Freelancers must provide accurate and complete information and notify GigHive of any changes to their status.
To the fullest extent permissible by law, GigHive and Platform Users are not liable for any indirect, consequential, punitive, or special damages arising from your use of the Platform. GigHive’s total liability shall not exceed the amount paid to you in the six months preceding the claim.
Freelancers agree to indemnify and hold harmless GigHive from any liabilities, losses, damages, or expenses arising from negligence or failure to perform Gig obligations.
This Agreement is governed exclusively by the laws of Zambia. Both parties consent to the exclusive jurisdiction of Zambian courts for any disputes arising from this Agreement. Both parties waive their right to a jury trial in any action or proceeding related to this Agreement.
BY ACKNOWLEDGING THE TERMS OF SERVICE AND/OR USING THE GIGHIVE PLATFORM, YOU EXPRESSLY ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS.
